These changes were proposed by the General Prosecutor's Office and include several key innovations:
- the establishment of the institution of private bailiffs;
- strengthening penalties for alimony debtors;
- the ability to impose a freeze on funds and valuables in bank accounts, not only by judicial authorities but also by bailiffs;
- the recovery of funds from bank accounts can be carried out by both judicial and private bailiffs based on enforcement documents;
- banks are required to provide information that constitutes banking secrecy to bailiffs based on relevant recovery documents.
He emphasized: "Access to information containing banking secrecy should only be granted by a court decision."
He also noted that the provision allowing for fines against private bailiffs for violations in their activities raises questions.
According to Omurzakov, the text of the bill appears as if it was prepared by two different people in official languages, as it contains significant technical errors.
Deputy General Prosecutor Umutkan Konkubaeva confirmed that all comments will be carefully considered.
