Deputy on the introduction of arrest for alimony debtors: Will half of the men in Kyrgyzstan be detained?

At the meeting of the Jogorku Kenesh on February 4, Samakov expressed concerns that with the introduction of the law on the arrest of alimony non-payers, temporary detention facilities may become overcrowded.

Deputy Attorney General Umutkan Konkubaeva presented the content of the draft law, which stipulates that evasion of alimony payments determined by a court decision, with a debt of more than three consecutive months or within a year, may lead to arrest for up to three days.

In the case of a repeated offense, the arrest period increases to seven days.

Release from liability is possible only upon full payment of the debt.

Additionally, private bailiffs will be able to demand the enforcement of court decisions.

Samakov also inquired about the number of non-payers in the country. In response, Konkubaeva stated that in 2025, 60,720 enforcement orders were handed over to bailiffs; however, this does not mean that all these individuals are non-payers, as some of them may have multiple documents.

The deputy warned that the number of debtors could increase fivefold with the introduction of the new law.

He also added: "Will half of the men in Kyrgyzstan be detained? I support the idea of accountability, but shouldn't we consider alternative measures, such as the seizure of property or a travel ban? The existing temporary detention facilities will not be able to handle such a number of detainees. Will this not lead to the ineffectiveness of the draft law?"

In response, Konkubaeva stated that the interests of children should be a priority. She clarified that measures should be applied to those who have not paid alimony for more than a year, suggesting that first, ten days should be given for voluntary repayment of the debt, then block funds in banks and impose a travel ban.

Last year, only 1,124 criminal cases were initiated on these issues, she noted.

The deputy commented: "The number of detainees will increase fivefold. Get ready," he said.
