Umutkan Konkubaeva, Deputy General Prosecutor, reminded that starting from July 1, 2025, an experimental regime will be launched for one year based on a presidential decree. During this period, the functions of enforcing judicial acts and other documents will be transferred from the Judicial Department to the General Prosecutor's Office.
During this transition, a Service of Judicial Executors will be created, and the institution of private judicial executors will be introduced.
The bill prepared by the supervisory authority details the functions of private judicial executors within the framework of the law of the Kyrgyz Republic "On the Status of Judicial Executors and Enforcement Proceedings." According to the document, the Service of Judicial Executors under the General Prosecutor's Office will carry out control and coordination of their activities, as well as issue certificates to private judicial executors and maintain a unified register.
The document also clarifies who can become a private judicial executor. According to Umutkan Konkubaeva, these executors will not receive a salary from the state budget; their remuneration will be 10% of the amount paid by the debtor.
In addition, the bill proposes to grant judicial executors, including private ones, the following powers:
- to declare debtors and their property in international or intergovernmental search;
- to carry out actions on the territory of foreign states in accordance with international treaties within the framework of enforcement proceedings;
- to refer debtors to organizations and institutions with which an employment contract has been concluded.
The bill also includes measures to tighten penalties for debtors, which was previously approved by the committee on finance, budget, entrepreneurship, and competition development.
After the discussion, the committee members unanimously approved the bill in the first reading.
