On the agenda today, March 3, were amendments to legislation concerning the tightening of penalties for drunk driving.

The proposed changes affect the Criminal and Criminal Procedure Codes, the Code of Offenses, and the Law "On Road Traffic." The main points are as follows:

The concept of this bill was approved by parliament in the first reading on January 15.

Deputy Bekeshev proposed amendments to the document, in particular, limiting the grounds for forced towing of vehicles.

He noted that towing is carried out in places where it is not required, which creates a business around it. Residents of the "Kok-Zhar" microdistrict have approached him for help, as there are no signs prohibiting parking, yet vehicles are still towed. "Have my proposals been taken into account?" the deputy asked.

Deputy Minister of Internal Affairs Oktay Urmambetov confirmed that the proposal has been accepted.

Bekeshev also suggested that information about towed vehicles be posted not only on the GUOBDD website but also in mobile applications such as "Tunduk" or "My City." Urmambetov promised to consider this.

Discussing the issue of alcohol intoxication, Bekeshev emphasized the need for a clear definition of the permissible blood alcohol content in legislation.
"How can one determine if a person is intoxicated? For example, if they drank yesterday and are sober today, but still smell of alcohol. Or, conversely, if a person drank a week ago, but traces of alcohol remain," he explained.

"Sometimes it is enough to drink kefir, and the test may show alcohol in the blood, even though the person is not drunk. It can also happen that the smell may come from a person taking medication, but that does not mean they are intoxicated," Bekeshev added.

He stressed that the law should clearly define what "under the influence" means.

Chairman of the Education Committee Suyunbek Omurzakov noted that it is possible to distinguish between a drunk and sober person without testing. However, Bekeshev reminded of the severe penalties that the bill entails: fines up to 80,000 soms and license suspension, and therefore it is necessary to clarify the blood alcohol content to avoid disputes.

Bekeshev proposed to enshrine this in a note to the law, noting that not all drivers may be aware of such nuances.

The deputy also emphasized the need for separate regulation of the status of scooter and electric scooter drivers, so as not to equate them with pedestrians. A representative of the Ministry of Internal Affairs agreed that this proposal would be taken into account.

Additionally, Bekeshev raised the issue of legalizing and registering illegally imported mopeds, which are often registered with a reduced engine capacity. He proposed allowing their legalization with subsequent registration.

Director of the State Center for Transport Registration and Driver Licensing Tynychek Saidov assured that the center would implement the corresponding decision if it is adopted. Urmambetov added that this proposal would be studied further.

The deputy expressed dissatisfaction that his proposals had not yet been considered.

"I submitted them a month ago, and I still receive the response: 'We will consider it,'" Bekeshev said with displeasure.

Deputy Bolotbek Borbieyev expressed the opinion that the blood alcohol content norm should remain at the level of a resolution, as special equipment is needed to determine the level of alcohol in the blood, which the Ministry of Internal Affairs does not have.

"Yes, the Ministry of Internal Affairs is not ready for this yet. Therefore, we are working within the framework of a resolution. Previously, deputies raised questions about determining the level of alcohol when consuming bozo or kumys, but this requires special equipment, which is not available. This takes time," agreed the Deputy Head of the Ministry of Internal Affairs.
