Amendments Made to the Law "On Public Procurement"

On January 22, 2026, the Jogorku Kenesh of the Kyrgyz Republic approved a new Law, which was signed by President Sadyr Japarov. This legislation is called "On Amendments to the Law of the Kyrgyz Republic on Public Procurement."

The main goal of the new Law is to optimize and rationally use budgetary funds at the republican and local levels when procuring various goods, works, and services.

According to the new provisions, procurements related to the organization of international high-level events, including visits by heads of state and delegations, are not subject to the regulations of the Law on Public Procurement. These procurements will be carried out through civil law transactions between the customer and the contractor in accordance with the current civil legislation of the Kyrgyz Republic.

In addition, the law introduces the concept of "state assignment." This implies orders to legal entities in which the state has a share in the authorized capital, funded by republican and local budgets, to fulfill key state tasks aimed at maintaining socio-economic stability and cultural development.

Procurements within the framework of the state assignment are also not subject to regulation by the Law of the Kyrgyz Republic on Public Procurement, and they will be carried out through civil law transactions between the state customer and the contractor, with a clear indication of the expected results.

The law is aimed at quickly resolving issues related to procurements in certain sectors funded by budgetary resources.

It is important to note that according to the new rules, both the state customer and the contractor of the state assignment bear personal responsibility for the targeted and effective use of budgetary funds within the framework of this assignment.
