The main goal of the new amendments is to ensure the effective and rational use of budgetary funds at the republican and local budget levels when procuring goods, works, and services.
According to this law, procurements related to the organization and conduct of international events at the state level funded by republican and local budgets, which involve the President of the Kyrgyz Republic, the Speaker of the Jogorku Kenesh, the Prime Minister, as well as visits by foreign leaders and delegations, are not subject to regulation under the law "On Public Procurement."
Such procurements will be carried out through civil law transactions between customers and contractors in accordance with the civil legislation of the country.
Furthermore, the law introduces the concept of "state assignment", which represents an order for the implementation of priority state tasks funded by budgetary resources to legal entities with state participation in the charter capital, aimed at maintaining socio-economic stability or socio-cultural development.
Procurements carried out under the state assignment are also not subject to the law "On Public Procurement" and are conducted through civil law transactions specifying performance indicators between the state customer and the contractor.
According to the new law, both parties—the state customer and the contractor of the state assignment—bear personal responsibility for the targeted and effective use of budgetary funds in the process of executing the state assignment.
