The amendments proposed by the Ministry of Economy and Commerce exempt from the current legal norms the procurements related to:
- the organization of international events at the state level, funded from the republican and local budgets, with the participation of the president, the speaker of the Jogorku Kenesh, and the chairman of the cabinet of ministers;
- ensuring visits of high-ranking foreign delegations, including ministers and heads of governments, as well as leaders of international organizations.
These procurements will be carried out based on a civil law contract between the customer and the contractor.
The bill introduces the term "state order," which allows for the procurement of goods, works, and services without adhering to the standards established in the Law "On State Procurement."
According to the document, a state assignment is considered an order funded from budgets, directed to legal entities with state participation in the authorized capital for the implementation of priority tasks that contribute to socio-economic stability and cultural development.
The contractor has the right to transfer up to 50% of the budget funds allocated for the execution of the state assignment to a subcontractor.
Such assignments may include orders in the following areas:
- culture and tourism activities, as well as the protection of historical and cultural heritage sites;
- education, science, and healthcare;
- organization of events conducted by the presidential administration;
- construction and repair of public roads of republican and international significance;
- economic development through the modernization of fixed assets;
- organization of official events at the state level with the participation of high-ranking officials.
During the discussion, Deputy Dastan Bekeshev expressed concerns about the increase in corruption risks.
“Currently, all stages of state procurement are transparent; it is clear how tenders are conducted and who wins them. After the adoption of these amendments, such information will become unavailable. Perhaps it is worth renaming the law to 'On State Orders' instead of 'On State Procurement.' How will subcontractors interact with state companies? This will lead to a decrease in competition and an increase in the role of state companies,” he noted.
As a result of the discussion, the bill was approved by the deputies in three readings.
