According to the municipality, the need to update the regulatory framework in the field of land relations has become relevant due to the adoption of the new Land Code of the Kyrgyz Republic.
According to the document, the current provision, adopted on January 14, 2020, contains outdated provisions, refers to previous editions of the code, and does not take into account modern approaches to regulating land purchase issues.
Analysis of law enforcement practice has shown that it is necessary to introduce additional guarantees for the fulfillment of obligations by tenants when purchasing. In this regard, the draft includes:
- the mandatory presence of a pledge agreement for the purchase;
- the possibility of alternative purchase by transferring 10% of residential premises to municipal ownership;
- the approval of a methodology for calculating the purchase price of land;
- the optimization of inter-agency interaction when processing purchase applications, including the exclusion of unnecessary procedures (for example, urban planning conclusions, if they are not required).
- to ensure more transparent purchase procedures;
- to reduce the processing time for applications;
- to increase revenues to the city budget;
- to replenish the municipal housing stock.
