According to the city administration, the need to amend the regulatory legal framework in the area of land relations has arisen due to the new edition of the Land Code of the Kyrgyz Republic.
The existing regulation on land purchase, approved by the resolution of the Bishkek City Council No. 139 on January 14, 2020, contains outdated norms and references to previous editions of the code, and does not take into account modern approaches to regulating issues related to land purchase.
Analysis of law enforcement practices has also revealed the need to introduce additional guarantees for tenants when purchasing land plots.
The new project proposes:
- the mandatory presence of a pledge agreement, which will serve as the basis for the purchase;
- the provision of an alternative form of purchase through the transfer of 10 percent of residential premises to municipal ownership in constructed apartment buildings;
- the development of a methodology for calculating the purchase price of land;
- the optimization of interdepartmental interaction when considering applications for purchase, including the exclusion of excessive procedures, such as urban planning conclusions in cases where they are not required.
The implementation of the proposed changes will allow:
- to ensure the transparency of the purchase process;
- to reduce the processing time for applications;
- to increase the revenues of the Bishkek city budget;
- to enrich the municipal housing stock.
