According to the resolution of the Cabinet of Ministers signed on February 19, 2026, the new rules will come into effect ten days after their official publication.
Payment for Notarial Services through the Electronic System
Now, for each notarial action, the state duty must be paid on the day it is performed via a platform integrated into the UISN.The system will record payment information, which will serve as confirmation of the payment made. Additionally, the text of the notary's certification will be generated exclusively through this electronic system.
Personal Presence when Formalizing Agreements
According to the new rules, certain socially significant agreements can only be formalized with the personal presence of the parties. Formalizing such documents through representatives is no longer allowed.These agreements include:
- marriage contracts;
- surrogacy agreements;
- documents for placing a child in a foster family;
- lifetime maintenance agreements;
- perpetual rent agreements;
- alimony agreements;
- agreements on parental rights.
Updated Rules for Minors Traveling Abroad
The changes also pertain to the procedure for formalizing consent for minors to leave the country.Now, the consent of parents, adoptive parents, or guardians for a child to travel unaccompanied, as well as for permanent residence abroad with one of the parents or guardians, will be formalized only for a limited period.
Requirements for Notarial Orders
The updated document clarifies the requirements for issuing notarial orders depending on the grounds for collection. This concerns situations such as:- collection based on notarially certified transactions;
- collection based on transactions in simple written form;
- collection based on bill protests;
- collection of alimony for minor children (in the absence of a dispute over parentage);
- collection of mandatory payments (excluding taxes and insurance contributions);
- collection of unpaid wages.
Notification of Debtors via Messengers
The procedure for notifying debtors about the issuance of a notarial order has also changed.A copy of the order must be sent no later than the next day after its issuance. However, now the notary can send the document:
- by mail with acknowledgment of receipt;
- by email in PDF format;
- through messengers such as WhatsApp, Viber, and Telegram;
- in direct messages.
Continued Digitization of Notarial Services
The Ministry of Justice also noted that digital services for notaries had already been implemented in the country, including:- remote notarial actions for Kyrgyz citizens abroad through the "Electronic Notary" system;
- remote execution of certain notarial actions;
- the pilot project "Electronic Apostille" with a full online cycle;
- increased qualification requirements for private notaries in the field of inheritance cases;
- expansion of international cooperation in the field of notariat.
