In Kyrgyzstan, the rules of notarial activity have been updated
According to the new rules, the fee for each notarial action must now be paid through a payment platform that is integrated into the Unified Information System of Notariat (UISN). Payment must be made on the day of the notarial action and the issuance of legally significant documents. The system will record the payment status and retain it, confirming the fact of payment. It is also specified that the text of the notarial inscription must be formed exclusively through the UISN.
Important changes also concern the procedure for concluding certain agreements, such as marriage contracts, surrogacy agreements, the transfer of a child to a foster family, lifetime maintenance, permanent annuities, and alimony agreements. These transactions must now be executed directly by the parties without the involvement of representatives.
The consent of parents, guardians, or custodians for the minor's departure outside Kyrgyzstan, as well as for their permanent residence abroad with one of the parents or guardians, is now issued for a specific period.
Changes have also affected notarial orders. The requirements for cases where enforcement occurs based on a notarially certified transaction, a transaction in simple written form, a bill of exchange protest, alimony for minor children (in the absence of a dispute), and mandatory payments (excluding taxes and contributions), as well as for accrued but unpaid wages, have been clarified.
In addition, the procedure for notifying the debtor has been changed. A copy of the notarial order must now be sent not only by mail with return notification but also in PDF format via email, as well as through messengers such as WhatsApp, Viber, and Telegram.
The new rules will come into effect ten days after their official publication.
It should be noted that serious reforms have previously been carried out in the notarial sphere, including the launch of remote notarial actions for citizens of the Kyrgyz Republic abroad using the "Electronic Notary" system, the expansion of the geography of this service, the pilot launch of the AIS "Electronic Apostille," as well as the remote execution of certain notarial actions starting from October 1, 2025. Measures are also provided to enhance the qualification requirements for private notaries in the field of inheritance cases and further integration of the notariat of Kyrgyzstan into the international professional community.
