The Ministry of Justice proposes to legalize digital evidence in criminal proceedings

A draft law is being developed in Kyrgyzstan aimed at introducing the institution of digital evidence and updating criminal and procedural legislation in light of modern digital technologies.

According to the Ministry of Justice, this document proposes amendments to the Criminal Code, the Criminal Procedure Code, and the Code of Offenses. It will establish the concept of digital evidence, as well as define the rules for their collection, recording, storage, and use in judicial proceedings.

Significant attention in the draft law is given to the protection of citizens' rights. Procedural guarantees are introduced for working with digital data, which pertain to the confidentiality of correspondence, personal information, and private life, as well as mechanisms for judicial oversight.

Furthermore, the document eliminates outdated terms, adapting them to the Digital Code of the Kyrgyz Republic, and introduces legal mechanisms for working with virtual assets, which are increasingly becoming targets for criminals.

The adoption of this draft law will create a modern and comprehensive legal framework for combating cybercrime, establish clear rules for handling digital data, and ensure uniformity in law enforcement. This will enhance the protection of citizens' rights and the effectiveness of investigations into crimes related to the use of the internet, digital services, and telecommunications networks.
