In the KR, they want to legalize digital evidence and the arrest of crypto assets
The document contains provisions regarding the rules for the recording, storage, and seizure of digital evidence, which should help avoid situations where such data may be deemed inadmissible in court.
As stated in the justification, the number of crimes related to digital technologies is constantly increasing, and existing laws do not correspond to modern realities. The authors of the bill propose to unify terminology in accordance with the Digital Code, update certain types of cybercrimes and investigation procedures, and separately address issues related to virtual assets.
According to the draft, there will be provisions for the arrest and seizure of crypto assets, their storage until a court decision is made, and a mechanism for the confiscation of equivalent assets or monetary amounts in cases where the assets have been hidden, destroyed, or alienated.
Additionally, the bill includes proposals for modernizing norms of international cooperation in the field of digital data, which will allow for the temporary retention of information upon requests and the exchange of materials in digital format in certain cases.
The note emphasizes that the implementation of this draft law will not require additional budgetary expenditures.
