The ombudsman helped two orphans from Naryn obtain inheritance

In Naryn, the ombudsman provided support to two orphans who were unable to obtain their inheritance due to the actions of their relatives, according to information provided by the Ombudsman Institute.

A request to the ombudsman’s representative was made by pensioner K.G., who asked for protection of her grandchildren's inheritance rights, aged 14 and 15, in the Naryn region.
In her appeal, the woman reported that her son A.M. and daughter-in-law O.Zh. divorced in 2014 after six years of marriage. The children stayed with their father, but their grandmother took on their upbringing.
Unfortunately, nine years ago, the boys lost their father, and in 2024, their mother also passed away. As a result, the Naryn City Court appointed the grandmother as the official guardian of the minors.
Social workers informed the grandmother that a plot of agricultural land was registered in the name of her deceased daughter-in-law. Upon learning this, she decided to register the land in her grandchildren's names as legal heirs, but the relatives of the daughter-in-law began to obstruct this process, refusing to provide the necessary documents.
Institute staff conducted a consultation and explained the grandmother's rights as well as the procedure for appealing to the court.
According to Article 1142 of the Civil Code of the Kyrgyz Republic, the first-order heirs include children, spouses, and parents.
Article 1159 of the Civil Code of the Kyrgyz Republic establishes that inheritance should be distributed by agreement among the heirs according to their respective shares, and in the absence of an agreement, through judicial proceedings.
After contacting the Ombudsman Institute, the woman was assigned a free state attorney through the Legal Assistance Service of the Ministry of Justice.
Additionally, a request was made to the regional branch of the State Agency for Land Resources, Cadastre, and Geodesy, which confirmed that the mother of the teenagers owned a plot of agricultural land measuring 58 hundredths in Naryn.
The ombudsman’s representative helped the grandmother gather all the necessary documents, after which she filed a lawsuit. As a result, the party contesting the land rights agreed to a settlement.
Ultimately, the minors received a certificate of inheritance rights, allowing them to register the land plot in their names.

Ombudsman Jamila Jamambaeva emphasizes the importance of upholding children's inheritance rights. She noted that the protection of children's interests is enshrined in the Constitution and is one of the main areas of the ombudsman's work.
