Ombudsman helped two minor orphans obtain an inheritance
According to the press service of the ombudsman, a pensioner, K. G., approached the representative of the akiykatchy in the Naryn region, requesting to protect the inheritance rights of her grandchildren, aged 14 and 15.
In her appeal, the woman explained that her son, A. M., and daughter-in-law, O. Zh., divorced in 2014 after six years of marriage. The children remained with their father, and their upbringing was taken care of by their grandmother. In 2014, they lost their father, and in 2024, their mother passed away. The Naryn City Court appointed the grandmother as the guardian of the minors.
Social workers informed K. G. that a plot of agricultural land was registered in the name of her deceased daughter-in-law. Realizing this, she decided to formalize the plot in favor of her grandchildren as legal heirs.
However, the relatives of the daughter-in-law began to contest the right to the land and created various obstacles by not providing the necessary documents.Specialists from the institute held a consultation with the grandmother, explaining her rights and the procedure for appealing to the court. The organization pointed out that according to Article 1142 of the Civil Code of the Kyrgyz Republic, the first-line heirs by law are the children, spouse, and parents. If the heirs cannot reach an agreement, the distribution of the inheritance occurs through the court in accordance with Article 1159 of the Civil Code of the Kyrgyz Republic.
After contacting the ombudsman’s institute, K. G. was provided with free legal assistance from a state lawyer through the legal aid service of the Ministry of Justice.
A request was also sent to the regional branch of the State Agency for Land Resources, Cadastre, and Geodesy. The agency confirmed that the mother of the teenagers owned a plot of land measuring 58 hundredths in Naryn.
“The akiykatchy workers helped the grandmother gather all the necessary documents, and she filed a lawsuit in court,” the press release states. “After that, the opposing party agreed to a settlement.”
As a result, the minors received a certificate of inheritance rights and were able to formalize the land plot in their name.
