The plaintiff claims that the decree and the draft put to a vote violate the constitutional law "On the Republican Referendum," which prohibits putting to vote questions that could infringe on the rights and freedoms of citizens. He also refers to the provision of the Constitution regarding the right of citizens to participate in the governance of the state both directly and through their representatives.

Ilyashev believes that the proposed document undermines the fundamental principles of the Constitution and insists on its inconsistency with the country's fundamental law.

He plans to seek the recognition of this document as invalid.

The referendum concerning the new Constitution is scheduled in Kazakhstan for March 15.

Alnur Ilyashev is known for his activism. In 2020, he was convicted for spreading knowingly false information related to criticism of the Nur Otan party (now Amanat) and the actions of the authorities during the pandemic. As a result, he was sentenced to three years of restriction of freedom and banned from engaging in public activities.
