Committee specialists emphasized that current legislation clearly regulates the procedure for checking and reviewing criminal cases.
According to the Constitution of the Kyrgyz Republic, the principles of separation of powers imply a clear delineation of authority among various government bodies. The norms of criminal procedural legislation establish that oversight of the legality of investigations conducted by investigative bodies, including the GKNB and the Ministry of Internal Affairs, is carried out by the prosecutor's office, while justice exclusively falls under the jurisdiction of the judicial authorities.
As reminded by the GKNB, in accordance with Article 8 of the Criminal Procedure Code of the Kyrgyz Republic, the review of judicial decisions can only be conducted by the relevant courts in the manner prescribed by law. The decisions of investigators can only be overturned by supervisory bodies.
In this regard, the committee believes that the initiative to create commissions for reviewing criminal cases contradicts constitutional principles, as legislation prohibits interference in investigative and judicial activities.
Furthermore, the agency noted that under the directive of the president, a large-scale reform is underway at the GKNB, covering almost all aspects of its work. This reform aims to adapt national security bodies to modern challenges, improve intelligence and counterintelligence activities, combat terrorism and extremism, as well as corruption and organized crime, and ensure the informational and economic security of the country.
The committee emphasized that all their work is carried out in strict accordance with the law and with respect for the rights and freedoms of citizens, which are guaranteed by the Constitution.
