The State Committee for National Security opposed the establishment of a commission to review criminal cases.
In the SCNS, it was emphasized that there is an established procedure regulated by law. Representatives of the agency reminded that according to the Constitution, all state power is based on the principle of separation of functions and powers among state bodies.
The press service noted that oversight of the legality of criminal investigations conducted by investigative units (such as the SCNS and the Ministry of Internal Affairs) is assigned to the prosecutor's office, while the judiciary is responsible for justice.
According to Article 8 of the Criminal Procedure Code of the Kyrgyz Republic, the review of sentences and other judicial decisions can only be carried out by competent courts in the manner provided for by the CPC. At the same time, procedural decisions made by investigators can be challenged by the supervisory authority.
The SCNS claims that the initiative to create any commission for the review of criminal cases contradicts constitutional principles, as legislation strictly prohibits interference in investigative and judicial activities.
Furthermore, the agency reported on the reform initiated by President Sadyr Japarov, which encompasses almost all aspects of its work.
“The SCNS reform aims to adapt national security agencies to modern challenges and threats, improve work in the field of intelligence and counterintelligence, combat terrorism and extremism, eradicate corruption, suppress organized crime, and ensure the informational and economic security of the country,” the press service clarified. The SCNS continues to operate within the framework of the law, respecting the rights and freedoms of citizens.
