The Housing Committee approved the gender norm of 70/30 for judges and the Cabinet in the second reading.
The bill was initiated by a group of 35 deputies. Its main goal is to improve legal regulation to ensure equal rights and opportunities for people of different genders in various spheres, including politics, economics, and culture.
The development of this draft law was carried out in conjunction with a project concerning amendments to legislative acts aimed at achieving gender equality. This project includes the laws "On State Guarantees of Equal Rights and Equal Opportunities for Men and Women," "On the Rules of Procedure of the Jogorku Kenesh," as well as amendments to the Criminal Code and the Code "On Offenses." Both bills are complementary documents.
As reported by deputy Kamila Talieva, the need for these amendments arose during the legal analysis of the law "On State Guarantees of Equal Rights and Equal Opportunities for Men and Women." This analysis was conducted as part of the inventory of legislation, according to the presidential decree of February 8, 2021, No. 26, which mandated an assessment of the compliance of laws with new constitutional principles, including social justice and the elimination of legal conflicts.
Among the proposed changes is the exclusion from the law "On the Council for Justice Affairs" of a provision that limits compliance with gender representation in the selection of judges only for courts with more than five members. This restriction leads to the fact that in more than 20 local courts, mainly located in the regions, the minimum requirements for gender equality (no more than 70% representatives of one gender) are not met.
According to the draft law, the chairman of the Supreme Court will be empowered to consider gender representation (no more than 70% of one gender) when transferring judges from local courts. Furthermore, the draft law also introduces a requirement for compliance with gender representation (no more than 70% representatives of one gender) when forming the Cabinet of Ministers. This requirement is supported within the framework of the National Strategy for Achieving Gender Equality by 2030 and the State Program for Supporting Women's Leadership.
Among the initiators of the draft law are deputies of the Jogorku Kenesh of the 7th convocation: Kamila Talieva, Nurlanbek Azygaliev, Chingiz Aydarbekov, Janarbek Akayev, Medera Aliev, and others.
