According to the law, there are only two types of punishment for this crime: death penalty or life imprisonment. The prosecution sought the death penalty; however, a moratorium on this punishment has been in effect in the country since 1997.
Earlier in January, Yoon Suk-yeol was sentenced to five years for attempting to obstruct an arrest during a conflict between presidential security and law enforcement agencies in January 2025. In total, he is involved in eight legal proceedings, four of which concern the declaration of martial law.
It is also worth noting that the court recently sentenced former Defense Minister Kim Yong-hen to 30 years in prison for his involvement in the coup.
Recall that on the night of December 4, 2024, Yoon Suk-yeol announced the imposition of martial law with the aim of "destroying pro-North Korean forces and protecting the liberal constitutional order."
