At Issyk-Kul, a meeting of young people ended in a traffic accident that resulted in the deaths of 3 people. The court issued a verdict for the perpetrator.

In the Issyk-Kul region, a verdict has been announced in the case of a traffic accident that resulted in the deaths of 3 people.

The defendant has been sentenced to 9 years in prison, and subsequently, the regional court imposed 3 years of probationary supervision.

Turmush reported on this traffic incident in April 2025. At that time, it was reported that in the city of Karakol, on the night of April 6 to 7, at the intersection of Gebze and Koenkozov streets, between approximately 01:00 and 02:00, a collision occurred between a "Toyota Ist" and a "Toyota Carina," resulting in fatalities.

The Internal Affairs Department of the Issyk-Kul region reported that a criminal case was initiated regarding the traffic accident, and forensic and technical examinations were appointed. The daughter of one of the deceased (who was in the "Toyota Ist"), N.R., born in 1982, stated that she last saw her mother on April 6. N.R. was returning home with friends from a café where they had been. They were traveling along Gebze street. The second car, as the daughter of the deceased recounted, came out from Koenkozov street and crashed into the taxi.

The deceased N.R. worked as a laboratory technician in one of the hospitals in the city. On that day, her colleague was also at the café. The woman recounted that after leaving the café, they called a taxi for her [the deceased N.R.].

According to the case materials published in the State Register of Judicial Acts, Shukhrat [name changed S.Ch.K.] on the night of April 7, 2025, at approximately 01:30, at the intersection of Gebze and Koenkozov streets in the city of Karakol, while in a state of alcohol intoxication, driving a dark red "Toyota Carina" without a driver's license and at high speed, failed to yield to a silver "Toyota Ist" traveling on the main road — on Gebze street — and collided with it. As a result of the traffic accident, three people died.

By the verdict of the Karakol City Court on July 10, 2025, Shukhrat [a native of the city of Karakol, with incomplete secondary vocational education, family status, father of two children, temporarily unemployed, previously prosecuted/Preventive measure in the case — detention since April 8, 2025] was found guilty of committing crimes under part 4 of article 312 ("Violation of traffic safety rules and operation of motor vehicles") and part 1 of article 144 ("Leaving in danger") of the Criminal Code.

For part 4 of article 312 of the Criminal Code, he was sentenced to 9 years of imprisonment with deprivation of the right to drive vehicles for up to 1.5 years, to be served in a general regime correctional colony.

For part 1 of article 144 of the Criminal Code, a fine of 200 calculated indicators (20,000 soms) was imposed, along with deprivation of the right to drive vehicles for up to 1.5 years.

Based on part 4 of article 77 of the Criminal Code, by summing the penalties, Shukhrat was ultimately deprived of the right to drive vehicles for 3 years. The main penalties are to be served independently.

The preventive measure of detention was left unchanged until the verdict comes into legal force. After the verdict comes into legal force, the preventive measure is subject to cancellation.

The term of serving the sentence is calculated from April 8, 2025. The time spent in detention before the verdict comes into legal force is counted at the rate of one day in detention for two days of imprisonment and included in the term of serving the sentence.

Shukhrat was ordered to pay 100,000 soms to the victim M.N.K., as well as 100,000 soms to R.K.M. as compensation for moral damage.

Disagreeing with this verdict, the defendant Shukhrat, through his lawyer, filed an appeal to the Issyk-Kul Regional Court. In the appeal, he stated that during the court proceedings, witnesses A.Z., B.M., and Ch.Sh., who are friends of the defendant, testified that on April 6, 2025, in the Kashka-Suu microdistrict, they met with N.Sh. and D.A. and consumed alcoholic beverages, but they stated that they could not assert whether Shukhrat had consumed alcohol or not. In this regard, the defense requested to change the verdict of the city court and issue a justified, fair, and legal judicial act.

No objections to the appeal were received.

At the court hearing, the defendant Shukhrat and his lawyer supported the appeal, stating that Shukhrat fully admitted his guilt, and an agreement on reconciliation had been reached with the victims, and there were no claims against him. In this regard, they requested to change the verdict of the city court and apply probationary supervision to Shukhrat.

During the court session, the victims K.R., N.M., A.A., as well as the representative of the victim N.M. — A.M. confirmed that an agreement on reconciliation had been reached with the defendant Shukhrat, they forgave him, and also requested to release him under probationary supervision.

At the session of the judicial panel of the Issyk-Kul Regional Court, D.A. was questioned as a witness, who reported that she is the daughter of the deceased R.N.A., and gave the following testimony. According to her, she has no family ties with the defendant Shukhrat; the deceased N. is her mother; she last saw her mother on April 6; that night her mother left with a friend; on April 8, her mother was buried. She also explained that after her mother’s death, her grandmother became ill, which is why she filed a statement.

At the court hearing, witness A.A.K. stated that the deceased N.Sh. was his classmate and provided the following testimony. Thus, on April 6, 2025, at approximately 21:00, he, along with classmate Sh.N.A., and B., A. and their friend Shukhrat went out to sit and chat. During this time, they consumed alcoholic beverages: the young men drank three bottles of cognac, and the girls drank beer. When Shukhrat was driving the car, he was in a state of intoxication.

After a while, they headed towards the café "I.P." in the city of Karakol. Upon arrival, Shukhrat, along with two friends, entered the café "I.P.", where he was absent for about half an hour. Then Shukhrat disappeared from sight, and his friends began to look for him. Going downstairs, the witness saw that Shukhrat was fighting with other young people. After that, the friends got out of the car, and shortly after, N.Sh.'s friend also exited the car. As soon as N.Sh. came out, Shukhrat approached and drove away in the car.

Later, in a subsequent contact, N.Sh. reported that she was heading up the road. After another contact, it became known that N.Sh. had been put into a car. When they were again heading towards the fight, the car, without stopping, ran over a "speed bump," the driver did not notice the approaching car from the other side. A collision occurred with the taxi.

The witness reported that as a result of the traffic accident, he suffered a concussion. After the accident, he got out of the car by himself, not noticing who had taken Shukhrat away. He also saw that D.N.Sh. died at the scene of the accident. The witness noted that he met Shukhrat the day before the incident, and they had consumed alcoholic beverages together.

At the first instance court hearing, witness J.A. was questioned, who stated that he is a friend of Shukhrat and provided the following testimony.

On April 6, 2025, at approximately 17:00, he met with B. and Shukhrat, after which they communicated for some time. Around 17:30, the three of them decided to relax and went to a shopping center located on Karasaev street in the city of Karakol, where they bought one bottle of cognac and non-alcoholic drinks. They then stopped in the Kashka-Suu microdistrict of the city of Karakol, where they all consumed cognac and smoked hookah. They did not consume vodka during this time.

Later, his friend B. called some girls he knew and invited them. After a while, N. and A. approached them. He had only seen N. once before, and he met A. for the first time that day; they had not met before. N. and A. consumed beer.

At around 23:30, Shukhrat suggested going to the café "I.P.". They went together with Shukhrat to the café "I.P." located on Karasaev street in the city of Karakol and entered, while N., A., and B. remained in the car.

After leaving the café, he did not find Shukhrat. When he asked unfamiliar people, they told him that he had gone behind the café building. After that, the witness drove up in a car and saw Shukhrat with two unfamiliar young men. When he and B. approached to find out what happened, Shukhrat got behind the wheel of his car and drove away. No one pursued him.

Trying to call Shukhrat, the witness realized that his phone was left in the car. They were at the location for about 40 minutes to one hour. Then they returned to the café "I.P.", where B. called his number from someone else's phone. The man who answered said that a traffic accident had occurred on Tynystanova street and asked them to come.

After that, they called a taxi and arrived at the scene of the accident. There were already traffic police officers and an ambulance crew, who subsequently left. The witness reported that they remained at the scene until deep into the night, around 03:00.

At the first instance court hearing, witness S.Ch.I. was questioned, who stated that he works in a taxi service. On April 6, 2025, while on the night shift, he received an order at the address: Przhevalsky street, No. 149. Upon arriving at the specified address and calling the customer, he received a response from the café administrator who said: "Four people are waiting for you downstairs, take a look." Approaching, he saw one young man and three girls.

Opening the car window, he asked: "Did you order a taxi?" to which they replied: "Yes, brother, please wait." For 2-3 minutes, they talked about something, after which everyone got into the taxi: one girl sat in the front passenger seat, two girls and one young man sat in the back.

The passengers stated that they were heading towards "I.P.". Moving up Gebze street, the witness did not notice a car moving at high speed. He noted that he was driving slowly because his car's power is low, and he is responsible for the safety of the passengers. According to him, he could not drive fast; the speed was approximately 50-60 km/h.

When he was driving on the main road, suddenly there was a strong impact, after which he lost consciousness. When he came to, he found himself outside the car and saw that two girls were lying on the ground, while the other injured had already been taken away by the ambulance crew. He noted that he was unconscious for about 10-15 minutes.

When he regained consciousness, he noticed that Shukhrat was no longer at the scene. He also reported that one of the women in his car died at the scene, while the other died in a medical facility.

The witness indicated that he did not file a statement with the law enforcement agencies and has no material claims against Shukhrat.

Having reviewed the case materials, the judicial panel of the Issyk-Kul Regional Court on October 29, 2025, decided to amend the verdict of the Karakol City Court dated July 10, 2025, regarding Shukhrat.

With the application of article 82 of the Criminal Code, the court ruled to release Shukhrat from serving a 9-year prison sentence in general regime correctional facilities and to impose probationary supervision for 3 years.

In accordance with the requirements of article 83 of the Criminal Code, to impose probationary obligations on Shukhrat. The preventive measure is canceled, releasing Shukhrat from custody in the courtroom.

It is clarified that the issue of compensation for moral damage is to be resolved through a civil claim by the victim N.K.M. in the civil proceedings.

The remaining part of the verdict was left unchanged by the Issyk-Kul Regional Court. The appeal was partially granted.

The verdict comes into legal force from the moment it is pronounced. The parties who disagree with the verdict have the right to appeal it in cassation to the Supreme Court.
