At its meeting on March 4, 2026, the Cabinet of Ministers decided to send the updated draft law on state secrets to the Great State Hural, along with proposals for the approval of the list of state secrets and related legislative initiatives.
It is proposed to change the name of the current Law on State and Official Secrets to the Law on State Secrets, as well as to create a legal framework that will exclusively regulate issues related to state secrets.
Deputy Minister of Justice and Internal Affairs Mönkh-Erdene Dembereltsüren noted: “There are more than 894 objects classified as state secrets. After the adoption of the new Law on State Secrets, they will become accessible to the public.”

Although the current Law on State and Official Secrets states that information can only be classified in legal and justified cases, in practice, many government agencies and officials have improperly used this mechanism for secrecy. This has negatively affected the transparency of public administration and violated citizens' rights to access information, creating conditions for corrupt activities and abuses.
Thus, the new version of the draft law aims to create a legal environment that ensures openness and transparency of information held by government agencies, except for data that is lawfully classified as state secrets.
According to current legislation, information that may "harm the interests of sectors, government agencies, or legal entities" can be classified as state secrets. This vague wording significantly expands the possibilities for classifying information, allowing data to be concealed in the interests of narrow groups. Therefore, the draft law excludes from existing provisions all norms related to state secrets.
