The draft law suggests amendments to the Code of Offenses, allowing protocols to be drawn up and decisions to be made in electronic form. The authors of the draft law claim that this will increase the efficiency and transparency of operations, as well as align with the trends of digitalization in public administration.
According to the justification, currently, protocols are primarily drawn up on paper, as existing code provisions do not allow for the use of electronic formats. In particular, Articles 517, 518, and 529 require mandatory signing and delivery of document copies. This forces employees to carry not only tablets but also printers for printing, as well as styluses for signatures, which increases budgetary expenses and creates additional burdens.
In the authors' opinion, the complete implementation of electronic protocols will improve administrative procedures, reduce costs associated with paper document flow, and optimize employees' working time.
Additionally, it is proposed that the procedure for drawing up electronic protocols be approved by the cabinet of ministers. The Ministry of Internal Affairs, together with the State Institution "Kyzmat" under the Presidential Administration, is already working on a mobile application for processing such documents.
However, the option to draw up protocols on paper will remain for cases where the use of electronic means is impossible or complicated.
Also, within the framework of the draft law, it is proposed to amend the Code of Offenses concerning automated information systems and the possibility of paying fines through mobile banking applications.
The Ministry of Internal Affairs emphasizes that both individuals and legal entities often do not pay imposed fines. In 2025, 1,400,751 protocols on offenses were drawn up, of which 203,885 remained unpaid, accounting for 20% of the total number.
In light of the above, it is proposed to amend the following laws:
- "On Road Traffic in the Kyrgyz Republic" — to refuse registration of vehicles and issuance of driver's licenses in the presence of unpaid fines;
- "On State Registration of Rights to Real Estate and Transactions with It" — to refuse registration of rights to real estate in the presence of unpaid fines;
- "On the Licensing and Permitting System in the Kyrgyz Republic" — to refuse the issuance of licenses or permits (including renewals or duplicates) in the presence of unpaid fines.
