Official could not answer Surabaldiyeva's question about the conflict of interest in public service

On March 12, a meeting of the Jogorku Kenesh took place, where amendments to the Law "On Conflict of Interests" were considered in the second reading.

In the new edition of the law, the concept of "affiliated person" has been expanded to include those who may influence decision-making through financial dependence, control, transactions, or close family ties.

Furthermore, the bill establishes that the government of the Kyrgyz Republic will determine the authorized bodies for the implementation of this law, one of which will be responsible for coordinating and monitoring its enforcement.

The procedure for verifying declarations of personal interests will also change — their verification is planned to be entrusted to the personnel services of various state bodies and local self-government.

Stricter liability for violations is also provided. Disciplinary responsibility will be introduced for providing false information in declarations, and failure to take measures to eliminate conflicts of interest may serve as grounds for dismissal.

Income and property obtained illegally will be considered a loss to the state and must be compensated.

During the discussion, Deputy Elvira Surabaldiyeva inquired whether any public servants had reported conflicts of interest.

She asked, "Has any authorized person ever declared a conflict of interest? Have there been cases where someone said, 'I cannot participate in this' and imposed self-restriction?"

In response, Ruslan Kubataliev, Deputy Director of the State Agency for Public Service and Local Self-Government, stated that no such cases had been recorded. Surabaldiyeva clarified why this was happening.

"It is probably related to the fact that the law was not functioning properly," the official replied.

She asked him to clarify what exactly is changing in the law to improve its operation.

Kubataliev explained: "Previously, public servants were not required to fill out declarations."

To which Surabaldiyeva remarked: "You are mistaken. All public servants are required to submit declarations, and this is verified by tax and other regulatory bodies."

Kubataliev suggested giving the floor to the head of the legal department of his agency.

Surabaldiyeva, pointing out his insufficient preparation, asked: "You are the rapporteur on this bill, so why weren't you better prepared? How long have you been in this position?"

Kubataliev responded that he had held his position for only two months. Further explanations on the bill were provided by the head of the legal department of the agency.
