Criminal Record for Alimony: Dastan Bekeshev Believes That Fathers' Debts Will Impact Children
Bekeshev expressed concern that the upcoming measure could hinder the employment of non-payers' children in law enforcement agencies due to their fathers' criminal records. "Not only does the father fail to fulfill his parental obligations, but he also creates obstacles for the child's future," he emphasized.
Deputy General Prosecutor Umutkan Konkubaeva added that criminal liability would apply to those who do not fulfill their alimony obligations for a year. Previously, such individuals would face administrative penalties, including a three-day arrest if they fail to meet their obligations for three months.
Kubanychbek Samakov, also a deputy, expressed doubts about the appropriateness of criminal liability. He noted that the number of complaints against non-payers could increase fivefold, leading to overcrowding in correctional facilities. "We currently have 60,000 such citizens, and this number could rise to 300,000. Are we really planning to imprison half of the men in Kyrgyzstan?" the parliamentarian questioned.
Samakov suggested considering alternative measures, such as property seizure, travel bans, and restrictions on civil law transactions.
As a result of the discussion, the General Prosecutor's bill "On Amendments to Certain Legislative Acts in the Field of Enforcement Proceedings" was adopted in the first reading. This bill introduces the institution of private bailiffs and strengthens penalties for alimony non-payers.
