Activists in Bishkek Challenge Restrictions on Rallies

In the Kyrgyz Republic, judicial proceedings continue regarding the provisions of the Law "On Peaceful Assemblies." Civil activists insist that these provisions infringe upon their right to hold rallies without unjustified restrictions.

On December 23, 2025, Tolekan Ismailova and Bermet Borubaeva appealed to the Constitutional Court requesting the recognition of certain provisions of parts 2 of Article 14 and part 2 of Article 15 as unconstitutional. These provisions grant local authorities the right to restrict the time, place, and route of peaceful assemblies, which effectively leads to the imposition of prolonged territorial bans.

The applicants argue that such practices contradict Article 39 of the Constitution and Kyrgyzstan's international obligations, particularly Article 21 of the International Covenant on Civil and Political Rights.

On January 26, 2026, the Constitutional Court rejected their appeal on the grounds of non-compliance with formal requirements, without specifying which particular provisions of the law on the Constitutional Court were violated. The activists viewed this as an obstacle to access to constitutional justice.

On February 2, they filed a complaint against the refusal, requesting a reconsideration of the case and the opportunity to participate in the proceedings.

In January 2026, the Pervomaisky Court extended the ban on holding rallies in the center of Bishkek until March 31, 2025. Only one area remained permitted for protest actions in the capital — the Maxim Gorky Park.
