Starting from January 30, 2026, a draft law titled "On Amendments to Certain Legislative Acts of the Kyrgyz Republic" will be put up for public discussion.
Deputy of the Jogorku Kenesh Marlen Mamataliyev is the initiator of this document.
This project proposes amendments to several legislative acts:
- The Family Code of the Kyrgyz Republic;
- The Law "On Civil Status Acts";
- The Law "On the Protection of Citizens' Health in the Kyrgyz Republic".
The explanatory memorandum states that:
- The development of medical technologies is outpacing legal regulation, creating legal gaps in matters of gender change in civil status acts;
- The author believes that such practice contradicts the traditional cultural and spiritual norms established in Kyrgyz society;
- Existing family law norms are strictly linked to biological sex at birth, reflecting the continuity of lineage and traditional views of family;
- The document emphasizes that the absence of a clear prohibition may lead to:
- Legal conflicts in the sphere of family relations (marriage, parenthood);
- Threats to the justice system and the execution of punishments (determining places of serving sentences);
- Abuses in the area of military duty;
- Difficulties for law enforcement agencies in identifying individuals;
- Violations of the principles of fair competition in sports;
- Undermining the stability of state registers and digital systems, which contradicts the goals of e-governance.
