Law on Silence: Housing Committees May Be Allowed to Draft Noise Reports

The Ministry of Internal Affairs of Kyrgyzstan has prepared amendments to the Code of Offenses, as well as to the laws "On the Basics of Crime Prevention" and "On Silence." Deputies discussed this draft law at a meeting of the committee of the Jogorku Kenesh, which deals with issues of law and order and crime prevention.

Deputy Minister of Internal Affairs Oktobyr Urmambetov reported that previously, the control over compliance with the silence law was under the Ministry of Health, specifically the Department of Health Promotion and Sanitary-Epidemiological Surveillance.

Now, as Urmambetov noted, it is proposed to transfer the authority to respond to citizens' complaints about noise to local self-government bodies and internal affairs, which will allow them to draw up protocols.

In addition, managers of apartment buildings will also be able to conduct preventive measures and, in case of violations, draw up acts to be submitted to state authorities.

In response to deputies' questions, the deputy minister mentioned that the current legislation already provides for fines for noise: 10,000 soms for individuals and 28,000 soms for legal entities. He added that if necessary, the possibility of increasing these fines could be considered.

The draft law also includes a provision allowing for non-compliance with silence norms during the New Year holidays from 10:00 PM on December 31 to 3:00 AM on January 1.

Representative of the Ministry of Health Ryspek Sydygaliev reported that noise control is carried out using special equipment.

“We have three types of sound level meters that are used to measure noise levels. However, we need another 16 units. We received 62 complaints regarding noise from ventilation systems and 79 complaints about noise from musical instruments, construction work, and singing. As a result, we drew up 30 protocols and imposed fines totaling 604,000 soms,” Sydygaliev added.

The deputy minister of internal affairs also noted that last year, 23 establishments, including cafes and nightclubs, were fined for violating the silence law.

Following the discussion, committee members unanimously approved the draft law in the first reading.

The law "On Silence" was signed in December 2024 and was initiated by deputy Dastan Bekeshev with the aim of protecting citizens' health from the harmful effects of noise exceeding permissible norms.
