The bill on the reform of homeowners' associations has been submitted for consideration to the Jogorku Kenesh.
Among the significant amendments is the simplification of the procedure for creating an initiative group, which will require only 10% of the votes from property owners. This group will be obligated to notify all property owners and to select a notary in advance who will certify the authenticity of the signatures of the participants in the founding meeting, which will help avoid falsifications and confirm the actual participation of owners.
The draft law also implies the creation of a mandatory register of HOA members, which will include information about property owners and the dates of their membership. This register will serve as the basis for verifying quorum at general meetings, and updated lists of HOA members will need to be submitted annually to the relevant registering authority.
Furthermore, it is proposed to improve the decision-making procedure: if there are owners of non-residential premises in the HOA, the meeting must be held only in person. The notary will also need to certify the signatures of all participants during in-person voting.
The term of office for the HOA board is proposed to be extended from two to three years, and a provision is to be introduced stating that the powers of the board end only after a new composition is elected, which will help avoid management gaps.
The developers of the draft law emphasize that these changes are aimed at preventing abuses, protecting the rights of owners, and improving the quality of management of apartment buildings. The document has already been published for public discussion.
