In Kyrgyzstan, fines of up to 120,000 soms are being introduced for the leakage of personal data

A draft law has been presented to the Jogorku Kenesh that introduces amendments to the Code of Administrative Offenses. These changes aim to strengthen responsibility for violations of norms related to personal data.

The document proposes the introduction of a new article covering liability for illegal actions related to the processing, storage, transmission, and dissemination of personal information. It is suggested that individuals be fined 7,500 soms, while legal entities would face fines of 65,000 soms. In the case of repeated violations, the fines increase to 25,000 and 120,000 soms, respectively.

Additionally, the draft law proposes the repeal of several existing norms (articles 4132-4135) that duplicate the new provisions.
The justification for the draft law states that these changes are necessary to align national legislation with the Digital Code, which provides a systematic approach to issues of processing and protecting personal data.
The draft law also clarifies the amounts of fines and redistributes the powers of the bodies responsible for reviewing such offenses.

The initiators of the draft law emphasize that the changes are primarily editorial and technical in nature, eliminate duplication of norms, and contribute to increased legal clarity in the field of digital data.
