It is necessary to create a Military Investigative Committee under the Military Prosecutor's Office of the Kyrgyz Republic


The Military Prosecutor's Office of the Kyrgyz Republic (KR) is in need of establishing an auxiliary operational-investigative unit – the Military Investigative Committee (MIC). The main task of the prosecutor's office is to oversee the activities of the Armed Forces, internal troops, national security agencies, and border services. In situations where the detention of suspects or the conduct of investigative actions is required, the prosecutor's office often seeks support from the Ministry of Internal Affairs, the Ministry of Defense, and other structures.

For example, to arrest suspects in criminal cases initiated by the Military Prosecutor's Office, special units of the Ministry of Internal Affairs or military forces are often involved. In cases where it is necessary to gather information on crimes related to cyber technologies, the prosecutor's office turns to the State Committee for National Security (SCNS) of the KR, as they have specialized units in the field of cybersecurity.

Thus, it becomes evident that the Military Prosecutor's Office lacks its own resources to conduct independent investigations, including technical and forceful means. By turning to other law enforcement agencies, the prosecutor's office risks facing leaks of confidential data and possible violations of investigative secrecy. This can also lead to conflicts of interest, especially when it involves SCNS employees or military personnel with special capabilities.

The establishment of the Military Investigative Committee (MIC) will significantly enhance the effectiveness of the military prosecutor's office by providing them with an independent mechanism for operational and investigative management, as well as their own special forces. The structure of this committee will include:

Operational search and detention department.Special technical investigations department (including cybersecurity and modern data collection technologies).Special operations department (special forces).External surveillance department.Expert-criminalistic department.Staff selection department.Office.

The Military Investigative Committee will be headed by a director and two deputies, who will be under state protection. The appointment of the MIC leadership will be carried out by a decree of the President of the KR upon the recommendation of the Attorney General and the Military Prosecutor. The financing of the committee's activities will be provided from the republican budget.

The process of selecting candidates to work in the MIC will involve the military prosecutor's office and the Main Intelligence Directorate (military intelligence) of the KR. Candidates may include both active military personnel and graduates of military educational institutions, as well as officers with experience in operational structures of the Armed Forces and army special units. The formation of the Military Investigative Committee will create conditions for its full-fledged and effective operation within the framework of the Military Prosecutor's Office of the KR.
