In Kyrgyzstan, the proposal to tighten punishment for particularly serious crimes against children and women has been raised again

The draft of the new law was presented for public discussion by the presidential administration


In the country, the idea of tightening punishments for the rape and murder of women and children has been initiated again. The presidential administration has brought the relevant bill to public discussion.

The developers of the bill noted that there is an increase in the number of serious crimes against children and women, which raises serious concerns in society and negatively affects the state structure.

“The protection of the rights of children and women is an urgent problem. Statistical data do not reflect the entire situation. Violence against these groups of the population tends to increase, and many crimes remain unregistered.
The facts of violence reported by the media, such as murders of women related to rape, are becoming commonplace, and society no longer reacts to this with the necessary shock, which is alarming. It is necessary to establish clear boundaries beyond which anyone who commits violent acts against children and women should be excluded from society and subject to strict and fair punishment,” the authors of the initiative assert.

As part of the bill, it is proposed to keep only life imprisonment with confiscation of property as the sole punishment for particularly serious crimes:

- murder related to rape or other forms of violent sexual satisfaction (paragraph 8 of part 2 of article 122);

- rape committed against a person under the age of fourteen or a person with a disability (part 4 of article 154).

It is also proposed to abolish the statute of limitations for murders:

- of two or more persons;

- of a woman in a state of pregnancy;

- of a child or a person in a helpless state;

- of close relatives related to professional activities or the performance of public duty;

- committed for hooligan motives;

- dangerous to the lives of many people;

- with particular cruelty;

- related to kidnapping or hostage-taking;

- associated with robbery, extortion, or acts of terrorism;

- based on racial, ethnic, national, religious, or interregional hatred;

- for selfish motives or in a hired manner;

- for the purpose of obtaining organs or tissues from the victim;

- to conceal another crime or facilitate its commission;

- committed by a group of persons;

- by prior conspiracy;

- by an organized group;

- as part of a criminal community;

- related to rape or violent sexual satisfaction in other forms.

It is worth noting that earlier in Kyrgyzstan, the issue of reinstating the death penalty for particularly serious crimes against women and children was also raised, but the Constitutional Court rejected this initiative.
