The request concerns the terms of office of the president and the procedure for conducting elections.
The President of the Kyrgyz Republic has appealed to the Constitutional Court for an official interpretation of specific provisions of the Constitution. In particular, it concerns the rules regarding the terms of office of the current president, as well as the procedures for appointing regular or early elections, as reported by the presidential administration.
The need for clarification arose due to various interpretations of the Fundamental Law in socio-political circles and among experts.
In order to prevent political tension and undermine trust in state institutions, the president requests an official interpretation of Article 67, the second paragraph of Part 2 of Article 68, and Part 1 of Article 72 of the Constitution (as amended on May 5, 2021), considering them in the context of the norms of the 2010 Constitution and the provisions of the Law "On the Constitution of the Kyrgyz Republic," which was adopted in a referendum on April 11, 2021. The question of the procedure and timing for both regular and early presidential elections is also raised.
The discussion of this request is scheduled for February 17. The Constitutional Court will prioritize its consideration, using a written procedure.
