Lawyer Tattuu Bubuu Ergeshbaeva has submitted a request to the Constitutional Court regarding the terms of office of the president according to the new Constitution of the Kyrgyz Republic. She published this information on social media.
In her appeal, the activist asks the court to clarify the provisions of Articles 67 and the second part of Article 69 of the Constitution of the Kyrgyz Republic, concerning the calculation of the term of office of the current president. This appeal was prompted by legal uncertainty arising from discrepancies between the text of the Constitution and the established practice following the 2021 reform.
According to Ergeshbaeva, the Constitution adopted on May 5, 2021, establishes a single five-year term of office for the president, without any exceptions or alternative mechanisms for extending the mandate.
However, following the events of 2020-2021 and the introduction of transitional regulations, a practice has emerged that considers the presidential term to be six years. This position has no basis in the Constitution and is not enshrined in norms, leading to a conflict between constitutional provisions and their practical application.
Ergeshbaeva emphasizes that without an official clarification and a unified understanding of the start of the presidential term, there is a risk of arbitrary expansion of the norms of the Constitution, which could violate the principles of the rule of law, legal certainty, and popular sovereignty.
She noted that only authorized state bodies have the right to request an official interpretation. In this regard, she expects an informational response from the court.
In addition, the lawyer plans to send a letter to the Jogorku Kenesh requesting the initiation of an official interpretation of the norms of the Constitution to eliminate the existing ambiguity.
It is worth noting that earlier, a group of 75 politicians and scholars sent an appeal to President Sadyr Japarov and the Speaker of the Jogorku Kenesh Nurlanbek Turgunbek uulu, asking to consider the possibility of holding early presidential elections.
