Human Rights Defenders: The Supreme Court Violated the Principle of Preparing the Case of Mahabat Tajibek Kyzy

Today, the Supreme Court of Kyrgyzstan violated the fundamental principles of preparing for the trial in the case of journalist Mahabat Tajibek kyzy, which contradicts the Constitution of the Kyrgyz Republic and international standards of fair trial (Article 6 of the ECHR, Article 14 of the ICCPR). The human rights organization "Bir Duyno - Kyrgyzstan" reported this.

Activists emphasize the importance of adhering to the equality of the parties, adversarial nature, disclosure of evidence, collegiality, and balance of interests for an effective judicial process. Key principles such as reasonable timeframes and effective preparation should facilitate the swift resolution of disputes, excluding unjustified delays.

Since 10 AM, independent journalists, activists, Mahabat's mother, Bolot's mother, representatives of the Ombudsman of the Kyrgyz Republic, media, victims of torture and unlawful arrests, as well as staff from international organizations and embassies, awaited the proceedings in the Supreme Court. The judges introduced the prosecutor, lawyers, and presiding judges; however, without familiarizing the collegium with the case materials, they stated the multi-volume nature of Mahabat's case and scheduled a hearing for March 3 at 11:15 AM," the human rights defenders reported.

In our opinion, the postponement of Mahabat's case by the Supreme Court of the Kyrgyz Republic is an act of arbitrariness on the part of the judges and an additional pressure on the victim of torture and injustice, who is in difficult conditions of a non-reformed prison system that has existed since Soviet times.

Human rights defenders also emphasize that the General Prosecutor's Office of the Kyrgyz Republic does not monitor the legality of the Supreme Court's decisions, and representatives of the Ombudsman institution do not respond to violations of the rights of victims of torture, which violates the principles of reasonable timeframes and effectiveness.

We remind you that Mahabat Tajibek kyzy was detained in January 2024 along with ten employees of Temirov Live. They were charged with organizing mass riots. On February 25, 2025, the Supreme Court reviewed the appeal of three of the detainees and upheld the decision of the lower court: Mahabat was sentenced to six years in prison, Azamat Ishenbekov received five years, and Aike Beishikeeva was placed on probation for three years. The court assigned three years of probation to Aktilek Kaparov, who did not appeal this decision. The other seven were acquitted due to lack of evidence of a crime.

The consideration of the defense's motion regarding newly discovered circumstances is scheduled for March 3 at 11:00 AM in the Supreme Court of the Kyrgyz Republic.
