Deputy Dastan Bekeshev expressed serious doubts regarding the draft law from the Ministry of Internal Affairs, which proposes the restoration of the recidivism institution. He emphasized that the changes place the Criminal Code above the Constitution, allowing crimes to be committed under the pretext of protecting economic or information security. "Thus, we are granting the right, especially to officials, to justify their actions, even if they are criminal. We are effectively creating conditions for immunity from punishment," Bekeshev stated.
In the deputy's opinion, this draft law contradicts the interests of citizens and has an anti-people character. "This draft law affects each of us. It should be rejected without even discussing it. We have no right to grant immunity to officials," he added.
Another deputy, Suyunbek Omurzakov, reported that the committee of the Jogorku Kenesh on law and order recommended removing Articles 18 and 50 of the Criminal Code from the draft law.
It should be noted that the controversial amendments concern Article 18, according to which certain actions may not be considered crimes if they do not pose a public danger or are aimed at protecting the sovereignty and security of the state.
Deputy Elvira Surabaldiyeva asked Deputy Minister of Internal Affairs Erkebek Ashirkhodzhaev whether the committee's conclusions were taken into account. Ashirkhodzhaev noted that all issues were discussed at the meeting, and a coordinated version will be prepared.
Surabaldiyeva added that public opinion on the controversial articles is divided, especially regarding the death penalty, as there remain doubts about the transparency of law enforcement agencies' work. She also suggested excluding these articles from the draft law.
As a result, the concept of the draft law was approved in the first reading, but with the need for further refinement.
