The court sentenced the deputy head of the "Cadastre" branch to a fine and a 3-year ban on public service.
According to the data presented in the case materials, amended in the State Register of Judicial Acts, the guilty party was Kuban [name changed Sh.K.S.], who, while serving as the deputy director of the Osh branch, committed an offense under the following circumstances.
During the investigation, it was revealed that a plot of land measuring 8,000 square meters, located in the Kalinin residential area of the city of Osh, was leased for 15 years for the construction of a private kindergarten and a foreign language school. This decision was approved by the Osh City Hall on October 8, 2003, in the name of S.N.M.
Based on this resolution, a certificate of temporary use of the plot was issued on December 28, 2009.
Subsequently, on June 20, 2019, the city hall transferred the plot for indefinite use to the municipal property management. On June 22 of the same year, a state act on the right of indefinite use with the designated purpose "social, settlement" was issued.
In August 2020, citizen Sh.I., who was actually using the plot, submitted a request for its transfer to private ownership through direct sale.
On August 28, 2020, at a meeting of the commission chaired by the vice-mayor of Osh J.A. and with the participation of the head of the municipal property management A.S., a decision was made to refuse the transfer of the plot, despite its estimated value of 12 million 480 thousand soms, as it was classified as a social facility.
Nevertheless, the investigative authorities believe that A.S., together with J.A. and other individuals, as well as the authorized representative I.I.T., sent a request to the Osh branch of the State Agency asking to change the designated purpose of the plot.
The request stated that the designated purpose had not been clarified at the city hall and asked to change it from "social" to "various".
On September 11, 2020, the agency's employees amended the state act on the right of indefinite use, replacing the wording "social, settlement" with "various", after which a new act was issued.
Then A.S. brought the issue of selling the plot to the commission for granting property rights or leases. Due to J.A.'s absence, the meeting was chaired by the head of the urban planning and municipal property department M.I. According to the protocol, the value was lowered to 10 million 400 thousand soms, and a decision was made to sell it at auction.
However, A.S., not complying with the commission's decision and without obtaining the plot plan, put it up for electronic auction at a reduced price.
At the auction, N.M.M. offered 12 million 480 thousand soms and was declared the winner.
On June 9, 2021, the city hall transferred the plot to private ownership. On the same day, a sales contract was signed, under which the plot was sold to N.M.M.
Kuban, remaining in office, registered the plot for N.M.M. on June 22, 2021, producing a state act on the right of private ownership. In order to conceal the crime, the designated purpose was changed back to "social".
Subsequently, N.M.M. divided the plot into four parts with new identification codes, on which commercial activities were conducted.
According to the report from the agency "Tüshtük Land Reform", the market value of the plots amounted to 200 million soms. On December 25, 2025, the plot owners N.M.M., N.A.M., N.I.M., and Sh.R.A. transferred them back to the municipality.
Kuban's actions were classified as abuse of office under part 3 of Article 320 of the Criminal Code.
During the pre-trial proceedings, the lawyer and the accused Kuban submitted a petition for a guilty plea. On December 26, 2025, a plea agreement was reached, according to which, upon fulfilling all conditions, the accused was to be fined 220,000 soms.
The agreement was approved by the court on December 26, 2025.
At the court hearing, Kuban fully admitted his guilt and requested a penalty in the form of a fine in accordance with the agreement. On January 22, 2026, the Osh City Court found him guilty under part 3 of Article 320 and imposed a fine of 220,000 soms, as well as a ban on holding government positions for three years.
The fine is to be collected for the benefit of the state.
The measure of restraint in the form of house arrest remains in effect until the verdict enters into legal force and will be lifted thereafter.
The verdict may be appealed within thirty days to the Osh Regional Court.
