Erkin, convicted of self-will, was aware that these plots were rented and had legal owners. Nevertheless, in June 2023, threatening a tenant named Musa, he illegally mowed clover, collecting a thousand bales.
After that, he mowed clover again, making another 400 bales, which he sold, causing damage to Musa amounting to 560,000 soms.
When Erkin returned to the field with threats, Musa contacted the police, which prevented Erkin from taking the mowed clover. However, later, with a knife in hand, Erkin cut the strings on 1,080 bales of hay belonging to Musa, causing damage amounting to 47,000 soms.
Additionally, knowing that the plot belonged to Alan, Erkin also mowed clover that same month, making 220 bales under the threat of physical violence. He repeated this action, making 300 bales and taking them, resulting in damage of 208,000 soms.
Returning to the field with a knife, Erkin again threatened Alan and cut the strings on 220 bales, causing damage of 11,500 soms.
- According to the decision of the Sokuluk District Court, Erkin was found guilty on five counts related to self-will with threats. He received a sentence of five years in prison, but with probation supervision for three years.
- The judicial panel for criminal cases of the Chui Regional Court upheld this decision.
The appeal mentions that the victim Alan claimed he had rented his land to the LLC "Ch." for a long time and had no conflicts with Erkin, which casts doubt on the legality of Erkin's actions. However, representatives of LLC "Ch." were not questioned in court.
The judicial panel of the Supreme Court, having considered the arguments of the cassation appeal and examined the case materials, decided to leave the verdicts unchanged and rejected the lawyer's appeal.
