The Supreme Court examined a criminal case involving a man who used his connections with criminal elements to extort money from residents of Osh.
According to information presented in the State Register of Judicial Acts, in the spring of 2020, Mukhtar [name changed M.M.M.] was aware that his acquaintance and fellow villager Ikrom, along with a friend, were being pressured by the leader of an organized crime group from the southern part of the country and his closest associates, including the "watcher" of the city of Osh. These individuals forced them to hand over 6.5 million soms to the criminal environment. Mukhtar took advantage of the fact that the pressure on Ikrom was particularly strong.

He brought Ikrom to the "Energia" gym located in the Anar microdistrict of Osh, where he introduced him to a certain B. Intensifying Ikrom's already difficult situation, Mukhtar brought out another person from the hall, I.A.S., who was also suffering from threats from criminal elements. After some time, he informed Ikrom that he had a one-month deadline to meet the demands, threatening him with consequences for any delay.

When the month expired, in early July 2020, Mukhtar came to Ikrom again and, applying psychological pressure, forced him to sell his cargo truck. On the same day, Ikrom reported that he had sold the truck on credit for $23,500 and handed over $10,000, adding that he still needed to gather another $10,000.

The collected $20,000 was exchanged for soms, and 1,560,000 soms were handed over to Mukhtar directly in the office in the Frunze microdistrict of Osh. However, Mukhtar demanded another 500,000 soms, giving a deadline of 15 days.

Ten days later, he came to Ikrom again, insisting on the urgent transfer of money, and Ikrom was forced to borrow a "Hyundai Porter 2" vehicle worth 700,000 soms from an acquaintance. Mukhtar took this vehicle, claiming to sell it for 450,000 soms and taking 50,000 soms.

The investigation established that Ikrom suffered significant material damage amounting to 3,363,000 soms.

By the decision of the Osh City Court dated August 12, 2025, Mukhtar was found not guilty under part 2 of article 267 ("Illegal circulation of weapons and ammunition") of the Criminal Code, as there was no composition of a crime in his actions. However, he was found guilty under part 1 of article 367 ("Concealment of a crime") and, due to the expiration of the statute of limitations, was released from criminal liability. The preventive measure of house arrest was replaced with a written undertaking not to leave, which was canceled after the verdict entered into legal force.

The judicial panel for criminal cases of the Osh Regional Court changed the decision of the Osh City Court on October 28, 2025. Mukhtar was found guilty under paragraph 2 of part 3 of article 41 ("Types of accomplices in a crime") and article 208 ("Extortion") of the Criminal Code and was sentenced to 5 years of imprisonment. The preventive measure was changed, and Mukhtar was taken into custody in the courtroom.

According to article 80 of the Criminal Code of the Kyrgyz Republic, the day of detention from September 20, 2024, to December 7, 2024, counts as two days of imprisonment, while five days of house arrest from December 7, 2024, to August 12, 2025, count as one day of imprisonment. The term of serving the sentence is calculated from October 28, 2025, in a general regime correctional institution. The rest of the sentence remained unchanged, and the appeal was partially granted.

Mukhtar's lawyer filed a cassation appeal with the Supreme Court, requesting the cancellation of the appellate court's decision and the upholding of the first instance verdict, pointing to the insufficient evaluation of evidence and hasty conclusions of the appellate court.

On January 26, 2026, the Supreme Court annulled the verdict of the judicial panel of the Osh Regional Court dated October 28, 2025, regarding Mukhtar and upheld the verdict of the Osh City Court dated August 12, 2025. The court ordered Mukhtar's immediate release from places of detention. The cassation appeal was granted, and this decision became final and not subject to appeal.
