Deputy Minister of Internal Affairs: Property confiscation is appointed only by the court

- During the discussion at the meeting of the Jogorku Kenesh Committee dedicated to issues of the judicial system and the fight against corruption, deputy Altynbek Kylchayev raised an important question about who exactly has the right to make decisions regarding the confiscation of property — investigative bodies or courts.

In response, Deputy Minister of Internal Affairs Erkebek Ashirkhodzhaev confirmed that only the court can make a decision on confiscation.

This discussion took place during the first reading of the draft Law of the Kyrgyz Republic, which proposes amendments to several legislative acts, including the Criminal Code, the Criminal Executive Code, and the Criminal Procedure Code.

The Deputy Minister stated that the aim of the draft law is to strengthen measures against organized crime and its complete eradication.

“Within the framework of this draft law, we plan to introduce the concept of recidivism of crimes and address a number of issues related to the confiscation of property,” added Erkebek Ashirkhodzhaev.

The changes proposed by the draft law concern three main codes and are aimed at tightening penalties for organized crime, introducing or clarifying the concepts of recidivism, as well as simplifying the procedures for confiscating property obtained illegally.

The committee has already approved the draft law in the first reading.
