The Committee of the Jogorku Kenesh approved amendments to the law on external migration in the first reading
At a meeting of the Committee on International Affairs, Defense, Security, and Migration of the Jogorku Kenesh, a bill concerning amendments to the Law of the Kyrgyz Republic "On External Migration" was reviewed and supported.
The initiator of the bill was the Chairman of the Cabinet of Ministers.
The information about the project was presented by the Deputy Head of the President's Office, Almaz Raimbekov.
As he noted, the bill is designed to simplify the procedure for issuing a general civil passport to citizens of the Kyrgyz Republic who have not reached the age of 16.
“The adoption of the bill will create conditions for more effective protection of children's rights, eliminate unreasonable difficulties for families, reduce the burden on the judiciary, allow authorized bodies and border services to perform their duties in strict accordance with the legislation, but without excessive restrictions on citizens' rights, and increase the accessibility of public services in the area of passport regulation,” said the speaker.
During the discussion, Deputy Zhyldyz Sadyrbaeva raised the issue of issuing a power of attorney (consent) for taking a child abroad. She noted that it is necessary to regulate the mechanism for obtaining parental consent not only for obtaining a passport but also for taking a child out of the country.
Deputy Cholpon Esenamanova also emphasized the need to consider the possibility of obtaining consent for crossing the border from one of the parents. According to her, it is important to take into account situations related to divorced families, where obtaining consent from the second parent poses difficulties. Deputies Gulya Kozhokulova and Burul Amanova also highlighted this issue. “The general civil passport, for which the consent of one parent is proposed, is used for leaving the country, while the departure itself is only possible with the consent of both parents. It turns out that we allow it, but at the same time there is a prohibition,” said Gulya Kozhokulova, suggesting that this matter be considered.
Deputy Yrysbek Atazhanov supported the initiative, emphasizing that the adoption of the law is necessary since currently, children cannot obtain a passport without the consent of both parents.
