The Ministry of Transport clarified the warranty obligations of contractors in road construction
The Deputy Minister reported that the warranty period for the reconstruction of roads is set at 3 years, while for new roads, this period is 5 years. He clarified that during this period, the deposit provided by the construction company remains with the Ministry of Transport as a bank guarantee.
“For 5 years, the deposit left by the company responsible for the road construction is held by the Ministry of Transport as a bank guarantee. If no deficiencies are identified after this period, the funds are returned to the company,” Bazaraliev explained.
In the event of defects being discovered, the contractor is obliged to correct them at their own expense. The Deputy Minister added: “If the company refuses to rectify the deficiencies, the ministry has the right to withhold the necessary amount from the bank guarantee.”
The deputy also asked about the measures taken against contracting organizations when violations are detected. Bazaraliev noted that during inspections of roads, a list of identified deficiencies is compiled, which is then sent to the contracting company for correction.
“I cannot recall cases where we have claimed funds from the bank guarantee. However, there have been situations where deficiencies were corrected by companies within the framework of their warranty obligations,” he concluded.
