The Ministry of Economic Development proposes to include the term "buyer’s compensating power" in the new edition of the competition law.

- The Ministry of Economy has initiated the inclusion of the term "buyer power" in the updated edition of the competition law. Relevant data was published on the official website of the Jogorku Kenesh.

This term will mean "the ability of a buyer to influence prices and terms of sale of goods or services, as well as the possibility of switching suppliers if a competitor offers more favorable conditions in terms of price and quality."

This definition will serve as a criterion for identifying companies as dominant players in the market, which will entail additional antitrust requirements.

In the event that the new law is adopted, the antitrust authority will be able to classify a company as dominant even with a market share below 35% if the buyer power in that market is either absent or limited, which does not allow for the restraint of the dominant participant.

It should be noted that the current version of the law, adopted in 2011, does not include the term buyer power.

The Cabinet of Ministers presented this draft law for consideration by the Jogorku Kenesh at the end of February.
