The lawsuit was filed against the backdrop of a data leak that occurred in 2024, when former IRS contractor Charles Edward Littlejohn provided Trump's tax information and that of other high-profile individuals to publications such as The New York Times and ProPublica.

Based on this information, The New York Times reported in 2020 that Trump had not paid income tax for many years. In 2024, Littlejohn was sentenced to five years in prison for violating the confidentiality of tax information under Section 6103 of the U.S. Internal Revenue Code.
