Self-Ban on Real Estate Transactions in Kyrgyzstan: The Law Presented for Discussion

In Kyrgyzstan, a draft law has been initiated that proposes the introduction of a self-ban mechanism on real estate transactions. This document has already been submitted for public discussion.

The proposed changes concern the law on state registration of rights to real estate.

According to this initiative, property owners will have the opportunity to voluntarily prohibit any actions related to registration, such as sale, donation, encumbrance, or re-registration.

This ban will be recorded in the Unified State Register, which will serve as the basis for refusing to register any transactions with the specified property.
At the same time, an application for imposing a ban can be submitted free of charge, either in person or through the electronic government services portal.
The owner will be able to lift the self-ban; however, its effect will cease only 24 hours after the corresponding changes are made in the register.

It is important to note that this mechanism will not apply to a number of situations, such as court decisions, inheritance rights, and corrections of technical errors.
According to the explanatory note, the purpose of the draft law is to protect citizens from fraudulent actions in the real estate sector, especially concerning elderly people.
It is expected that this innovation will help reduce the number of cases of illegal re-registration of housing and increase the level of protection of property owners' rights.

After the public discussion is completed, the draft law will be revised taking into account the proposals received.
