For the first time, the draft law introduces a clear definition of an investment agreement — an official contract between the investor and the state that regulates their rights and obligations. Such agreements facilitate large investments into the country, exceeding 1 billion soms. According to the developers, existing regulations often lead to ambiguities, causing delays and risks of litigation.
The project also clarifies the procedure for transferring land plots that are state-owned. Now, the conditions for land transfer for both citizens of Kyrgyzstan and foreign investors will be determined by the Cabinet of Ministers.
The draft law establishes that land plots intended for the implementation of national projects can be transferred for temporary use for up to 50 years.
Additionally, there is a provision for the phased extension of usage rights, provided that the investor fulfills all obligations.
Significant attention is given to eliminating legal ambiguities: it specifies when free land provision is possible, in which cases an auction is necessary, and how the state can contribute land plots to the charter capital of companies with state participation. These changes, according to the authors, will help close existing gaps in legislation and reduce administrative barriers.
The explanatory note to the draft emphasizes that the changes are aimed at protecting investors, increasing the country's attractiveness for investments, and accelerating the implementation of projects significant for the economy of Kyrgyzstan. The document is already available for public discussion, and all interested parties can submit their proposals and comments within the established timeframe.
