Temirlan Aitieff, a deputy, proposed to amend the law regarding the inheritance of property by individuals who are not relatives of the testator. The draft of this law is already available on the website of the Jogorku Kenesh for discussion.

According to the initiator, the Constitution and the Civil Code guarantee every citizen the right to dispose of their property, including the ability to bequeath it to individuals who are not close relatives.

However, as the deputy points out, in practice there are shortcomings in the legislative acts that unjustifiably hinder citizens from exercising their legal rights to inheritance if they are not close relatives of the testator.

Specifically, there are cases where a citizen faces difficulties obtaining a death certificate of the testator from a notary (necessary for opening the inheritance), as state authorities do not issue this document, citing the Law "On Civil Status Acts," which states that they are not a close relative of the testator.

Thus, such a situation violates the rights not only of those who inherit but also of the testator themselves, who wishes to leave their property to those they trust.

In this regard, the draft law proposes to eliminate the mentioned legal shortcomings by adding a provision to Article 9 of the Law "On Civil Status Acts" that will grant individuals who present a notarized will the right to obtain a copy of the death certificate.
