According to reports, the investigator of the Karakol City Department of Internal Affairs chose this preventive measure for two suspects. Specialists from the monitoring department of the Ministry of Justice installed electronic bracelets on them and connected the corresponding mobile application.
Electronic monitoring is a means of controlling the movements of individuals whose freedom has been restricted. The bracelet, which requires prolonged wearing, prevents unauthorized removal, and monitoring is carried out through a special mobile application developed by the Ministry of Justice.
The main objectives of introducing electronic monitoring are:
— ensuring compliance with established restrictions and prohibitions for the accused;
— conducting remote control and monitoring.
However, electronic monitoring is not applied:
— in cases of particularly serious crimes;
— for serious crimes provided for in Section VI of the Criminal Code of the Kyrgyz Republic.
The decision to introduce electronic monitoring can be made by:
— the investigator, prosecutor, investigative judge, or court;
— provided there is a petition from the accused, their lawyer, or legal representative.
The document must specify:
— the territory beyond which the accused is not allowed to be;
— the established prohibitions and restrictions;
— the authority or employee responsible for monitoring compliance with the conditions.
The obligations of the accused include:
— a prohibition on leaving the established territory without the bracelet;
— compliance with all established prohibitions and restrictions;
— the inadmissibility of obstructing the investigation and judicial proceedings;
— appearing when summoned within the established timeframe.
In case of violation of the conditions of electronic monitoring, a stricter preventive measure may be applied to the accused.
This event marks the first step towards the implementation of a new mechanism aimed at ensuring public safety while respecting human rights within the framework of the law.
