Kyrgyzstan has filed a lawsuit against Russia in the court of the Eurasian Economic Union, as reported during a meeting of the Jogorku Kenesh committee dedicated to labor, health, and social policy issues. The main problem lies in the Russian side's failure to fulfill the conditions of the EEU agreements regarding the issuance of insurance policies and medical care for migrants from Kyrgyzstan. What is the EEU and its court?

The Court of the Eurasian Economic Union, established under the EEU treaty on May 29, 2014, is a permanent judicial body of the union. It is located in Minsk, Belarus.

The chairman of the court is Alexey Dronov, who previously served as the Consul General of Russia in Bonn, and the deputy chair is Aizhamal Azhybraimova, a former judge of the Supreme Court of Kyrgyzstan.

What is the function of the EEU court?

The main task of the court is to ensure the uniform application of the norms of the EEU Treaty, as well as international agreements concluded within the framework of the union and the decisions of its bodies.
The court consists of two judges from each member country of the EEU.

What is the focus of Kyrgyzstan's lawsuit?

The head of the Mandatory Health Insurance Fund of the Kyrgyz Republic, Azamat Mukhanov, emphasized during the meeting that the Russian side is not fulfilling the conditions specified in the EEU agreements, according to which compulsory health insurance policies must also be issued to the family members of those working in Russia.
Later, it was clarified by the fund that the initiative to file a lawsuit was given by the Cabinet of Ministers, and the lawsuit was submitted by the Center for Judicial Representation under the Ministry of Justice of the Kyrgyz Republic.

The lawsuit concerns the clarification of the provisions of paragraphs 3 and 4 of Article 98 of the EEU Treaty dated May 29, 2014, specifically regarding access to social security, including compulsory health insurance, for family members of workers from EEU member states.

The fund noted that this issue is regularly raised by the Kyrgyz side in the working bodies of the union, and the appeal to the court is part of the dialogue within the framework of integration processes.

What does the treaty mention?

Since January 1, 2017, workers from EEU countries have gained access to health insurance in Russia.
Article 98. Rights and Obligations of Workers from Member States
Appendix states that emergency medical assistance is provided to workers and their family members free of charge, regardless of the presence of a medical policy. However, if treatment continues after the immediate threat to life or health has been eliminated, the patient is obliged to pay the actual costs according to tariffs or contractual prices.

How does Kyrgyzstan fulfill the treaty conditions?

The Mandatory Health Insurance Fund emphasizes that Kyrgyzstan strictly fulfills its obligations within the EEU.
Family members of workers from allied countries who are legally present in Kyrgyzstan have access to medical assistance under the compulsory health insurance program according to the state guarantees program.

Changes in Russia's migration legislation

New rules regarding migration policy have come into effect in Russia.

The conditions for obtaining a medical policy for foreign citizens have also changed. According to the information and legal portal "Garant," migrants must legally work in Russia for at least five years to receive free medical assistance.

When is the court's decision expected?

On January 27, 2026, the head of the Mandatory Health Insurance Fund, Azamat Mukhanov, reported that the court session had already taken place, and the decision would be announced in two weeks.
