A Bishkek resident reported police inaction regarding the torture of children by their father

Aizhamal D. contacted Kaktus.media with a complaint about the inaction of law enforcement agencies. Her report of violence by the children's father was submitted back in April 2025, but there has been no action from the police so far.

Background

According to Aizhamal, she was married to A. M. and six years ago, after another act of violence, she fled with two children.
"I fled barefoot at night with the children, knowing that staying would risk our lives," she shares.

"We were married for a short time. At the time of the divorce, our son was three years old. The reason for the divorce was physical and psychological violence from my husband. After another beating, I moved to Bishkek with my son. A few months later, A. M. returned, asked for forgiveness, and promised that everything would change. We started living together again. At that time, he was not working and stayed at home, while I had to go to work to support the family since we had a little daughter. This did not suit him, and he began to beat me, even threatening me with a knife in the most terrifying situations. I was forced to flee to my aunt. Ultimately, after another beating in the street, we divorced," Aizhamal recounts.

The ex-husband showed no interest in the children, did not participate in their upbringing, and stated in court that they should stay with their mother.

"I was forced to leave the children with their father, as otherwise, I would have to return the grant, which was impossible. I hoped that A. M. would allow the return of the children, but when I went abroad for studies, he forcibly took the children from their grandfather and cut off contact," Aizhamal explains.

As soon as she had the opportunity, she returned to see the children.

"During a visit to the psychologist appointed by the court, I met with the children. In the office, he suddenly agreed to let them stay with me. We spent time together, and I noticed that they were very tense," Aizhamal says.

"When I asked my daughter, she started to cry and told me that her father beats her with a belt on the legs if she does not get up. She also said that they only have cereal and eggs at home, and that her brother eats only once at school. She was afraid to speak because dad threatened her that if she told, she would get punished even more," she continues.

The next day, Aizhamal went to the police.

"I filed a report of violence against the children, but the investigator did not want to open a case, stating that there were no signs of beatings. I was told that such cases often end in reconciliation and advised to remarry to protect myself. Does this mean that the police will not help, and another man should take care of the woman?" the woman is outraged.

Since then, the case has not progressed. Aizhamal suspects that her ex-husband is using his connections, as his father is a former police officer. Thanks to the prosecutor's office, the report is still with the police, but without any progress.

Results of the Examination

The psychological examination showed that both children are experiencing psycho-emotional trauma due to violence and threats from their father.

The children experience fear and depression when recalling life with their father, while being with their mother is perceived as safe and supportive (from the psychologist's conclusion).

According to the children's testimonies, the father applied physical punishments and threats, which confirms their accounts. Considering their age and the consistency of their stories, one can conclude the truthfulness of the situation. Despite their fear, both children expressed a desire to live with their mother, who creates a safe environment for them.

Refusal to Initiate a Case

Aizhamal noted that the court decided to deprive her ex-husband of parental rights based on the psychological examination. However, the investigators of the Oktobersky District Department of Internal Affairs do not take this into account.

"The court recognized that the father abused his rights and treated the children cruelly, based on the UN Convention on the Rights of the Child. However, the police refuse to initiate a criminal case, citing the unreliability of the children's testimonies and the need for additional examination. The court trusted the children's testimonies, but the police did not," she added.

Police Response

The Oktobersky District Department of Internal Affairs confirmed that Aizhamal had filed a report. She requested measures to be taken against her ex-husband, who is alleged to be abusing the children.

This case has been registered, and a preliminary investigation has begun.

A. M. also filed a petition for a psychological and psychiatric examination, which has been appointed, and a legal assessment will be given based on its results. However, when asked why another examination is needed and why no actions have been taken regarding the report submitted in April 2025, the police did not respond.
